2012 PAR Photography Contest: Capture the Connection
Terms and Conditions

PAR, Inc.’s 2012 Photography Contest, “Capture the Connection,” is open from 8:00 a.m., EST, on May 3, 2012, until 6:00 p.m., EST, on November 30, 2012. No purchase necessary. A purchase will not increase the odds of winning.

By submitting entries, each entrant agrees to these Official Rules and warrants that his or her entry complies with all requirements set out herein. This is a skill-based contest, and chance plays no part in the determination of winners. Winners will be announced December 15, 2012.

ELIGIBLE ENTRANTS
Contest is open to any qualified level B, C, or S professional who is aged 18 years or older and is a U.S. resident. In accordance with the Standards for Educational and Psychological Testing and PAR’s competency-based qualification guidelines, many tests and materials sold by PAR are available only to those professionals who are appropriately trained to administer, score, and interpret psychological tests. To review and verify your qualification level, please visit our FAQ. Final winners selected must satisfy criteria for qualification level B, C, or S to be eligible for our contest prizes.

Qualified level B, C, and S professionals who are not current customers may register with PAR, Inc. at https://www4.parinc.com/Registration/Register1.aspx. No purchase is necessary to register, but registration is required to enter the contest.

Employees of PAR, Inc., and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, and siblings and their respective spouses, regardless of where they live) or persons living in the same households of such employees, regardless of relation, are not eligible.

ENTRY SPECIFICATIONS
Photographs must be submitted online through PAR, Inc.’s Web site at http://capture.parinc.com. PAR, Inc. cannot accept photographs submitted by postal mail. No more than three (3) photographs per seven (7) day period may be submitted. PAR, Inc. cannot accept more than one contestant per e-mail address, as defined by your PAR customer registration.

No print or film submissions will be accepted for entry. The photograph need not be taken with a digital camera; scans of negatives, transparencies, or photographic prints are acceptable. Digital photographs should be taken at the highest resolution possible. Photographs must be in a .jpeg or .jpg format. Files submitted may not be larger than 10 Mb. Proof of submission is not proof of receipt.

Only unaltered photographs will be considered. Only minor burning, dodging, and/or color correction is acceptable, as is cropping. Any changes to the original photograph not itemized here are unacceptable and will render the photograph ineligible for a prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; entrants must be prepared to provide a release form as described below. Photographs of others’ works must constitute the work in its environment and not a full-frame close-up of another person’s art. The photograph must not, in the sole and unfettered discretion of the sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

The photograph, in its entirety, must be a single work of original material taken by the entrant. By entering the contest, the entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant; that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity, or intellectual property rights of any person or entity; and that no other party has any right, title, claim, or interest in the photograph. PAR, Inc. reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

LICENSING
By entering the contest, entrants grant PAR, Inc., a royalty-free, worldwide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any educational, promotional, publicity, exhibition, archival, scholarly, and other standard PAR, Inc. purposes. Any photograph reproduced will include a photographer credit as feasible. PAR, Inc. will not be required to pay any additional consideration or seek any additional approval in connection with such uses. Although PAR, Inc. has the above stated usage rights to the photo, the photographer retains original copyright of the image. Potential winners shall be required to sign and return, within fifteen (15) days following an attempted notification, an Affidavit of Eligibility, Liability Release, and, where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to PAR, Inc. and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (including a photographer credit as feasible) in connection with and promotion of the contest without additional compensation. Failure to execute and deliver any required documents to PAR, Inc. by the specified deadline may result in disqualification from the contest and selection of an alternate winner.

If the photograph contains any material or elements that are not owned by the entrant and/or that are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/territory of residence, the signature of a parent or legal guardian is required on each release. At PAR, Inc.’s request, each entrant must be prepared to provide (within seven (7) calendar days of receipt of request) a signed release from all persons who appear in the photograph submitted and/or from the owner of any material that appears in the photograph entry, authorizing PAR, Inc. and its licensees to reproduce, distribute, display, and create derivative works of the entry in connection with and promotion of the contest, in any media now or hereafter known. All releases must be in the form provided by PAR, Inc.. Failure to provide such releases upon request may result in disqualification at any time during the contest and selection of an alternate winner. The model release form can be accessed here. The entrant will be deemed to be in receipt of PAR, Inc.’s request or notification (a) five (5) business days after PAR, Inc. sends the request by postal mail, or (b) the same day that PAR, Inc. sends the request by e-mail.

PAR, Inc. intends to post selected submissions to an online gallery, located here. Due to the volume of submissions and the selection criteria, not all submissions will be posted to the online gallery. If a submission is rejected, PAR, Inc. will provide a rejection reason. Please allow up to 10 business days for submission review and posting to the online gallery.

CONTEST PRIZES
The first place winner will receive a Canon EOS® 60D 18.0 megapixel digital SLR camera, camera bag, 8 GB memory card, and a Canon EF 70-300 mm telephoto zoom lens; retail value of $1,800.00 USD.

The second place winner will receive a Canon Rebel® T3i 18.0 megapixel digital SLR camera, camera bag, 8 GB memory card, and a Canon EF 75-300 mm telephoto zoom lens; retail value of $1,000.00 USD.

The third place winner will receive a Canon Rebel® T3 12.0 megapixel digital SLR camera and a Canon EF 75-300 mm telephoto zoom lens; retail value of $600.00 USD.

All federal, state, local income, and/or other applicable taxes are the winner’s sole responsibility. Winners must complete and return to PAR, Inc. a W9 form for tax purposes. Noncompliance or return of prize notification as undeliverable, whether by regular mail or e-mail, may result in disqualification and selection of an alternate potential winner. CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

No prize transfer, assignment, or substitution by winners is permitted. If a prize (or part of a prize) is unavailable, PAR, Inc., at its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize that is monetarily or substantively equal, unless to do so is prohibited by law. PAR, Inc. shall be responsible only for awarding the number of prizes as stated in these Terms and Conditions. Prize has no cash alternative. Winner is responsible for any additional costs related to hardware, installation, and network integration plus any tax liability.

JUDGING
Judging will be conducted by a panel consisting of PAR, Inc.’s Director of Marketing and CEO and two professional photographers independent of PAR, Inc. The judges will select first-, second-, and third-place winners from all entries based on the entry and judging criteria specified below. Winners will be chosen on or around December 15, 2012, and notified by e-mail and phone. Judges’ decisions are final and binding.

JUDGING CRITERIA
Entries will be judged on creativity, composition, photographic quality, and appropriateness to the theme.

LIMITATION OF LIABILITY
By entering this contest, entrants agree to release, discharge, and hold harmless PAR, Inc., and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this contest or any contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

PAR, Inc. assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to contest entries or entry forms; or alteration of entries or entry forms. PAR, Inc. is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, human errors of any kind, or any combination thereof, including any injury or damage to entrants’ or any other persons’ computers related to or resulting from participation in or uploading or downloading of any materials related to this Contest.

CONDITIONS
To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from connection with this contest are hereby excluded, and any entrant expressly waives any and all such rights. Certain restrictions may apply. An entry is void if PAR, Inc. determines the photograph to not be an original or if the entry is illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the judges are final and binding with respect to all matters relating to the contest; and (c) that PAR, Inc. may use winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the contest or future promotions without compensation or approval (except where prohibited by law).

PAR, Inc. reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by PAR, Inc. to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST
If, for any reason, the contest is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of PAR, Inc. that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, PAR, Inc. reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the contest and/or to disqualify any individual(s) who tamper with the entry process. If PAR, Inc. elects to cancel or terminate the contest, it will not retain any usage rights in the submitted photographs.

WINNERS LIST
Entrants are responsible for complying with these Official Rules. Winners’ names will be available online at www.parinc.com after December 28, 2012.

DATA PRIVACY
Entrants agree that personal data, especially name and address, may be used for the purposes and within the context of the contest and any other purposes outlined in these Official Rules. The data may also be used by PAR, Inc. in order to verify the participant’s identity, postal address, e-mail address, and telephone number. Entrants acknowledge that the information provided may be used to communicate with the entrant in relation to this contest as well as for other purposes.
